Distracted driving can lead to serious injuries. Today, T. Scott Jones talks about distracted driving, and what you need to know.
What is included in Tennessee’s distracted driving laws?
Distracted driving law in Tennessee is something that has recently come about, particularly through legislative action in order to deter folks from using electronic devices while operating a motor vehicle. It’s extraordinarily important that you pay attention to the road and your surroundings, because you’re operating a vehicle that can affect the lives of other individuals. If you’ve either been a distracted driver, or the victim of actions by a distracted driver, you need an attorney to protect your interest. I want to be that attorney.
If I was texting when I was involved in an automobile accident, am I automatically to blame?
Texting, or distracted driving, can lead to accidents. It can also to lead to liability. In particular, if you’re using any type of a mobile device – you can call it texting, you can call it Facebook, you can call it Snapchat, Instagram – however you use that device, if it distracts your ability to maintain a lookout in the direction in which you are driving, then you’re likely going to have a problem.
Also with the ability to recover the metadata from the actual device, the investigation of these accidents has taken on a whole new turn. So you need to be careful when you’re operating a vehicle and understand that you need to be paying attention to the roadway as a responsible driver and as an individual that cares about the rights and the shared roadway with others.

Are phone records always pulled in car crash lawsuits?
Are phone records pulled? You’ve had an accident, is somebody gonna go back and get your records? Or is somebody gonna go back and get the records of the other driver? Quite possibly yes. You need to be aware of that. That’s another factor with regards to distracted driving.
Also, you’re gonna need an attorney that sends a preservation order to the mobile carrier of both your device and the device of the offending driver, if you want these records preserved. I think most folks are aware that the companies only keep these records for a period of time.
That being said, I want to be that attorney that stands up for you, helps you during this period of time, and sends that preservation letter. My name is T. Scott Jones and my law firm is Banks and Jones. My number is (865) 546-2141 or you can contact me at banksandjones.com.
